These Terms set out the conditions for using Betta Aquarium Overlay (the “App”), provided by Reiwa Labo RO (the “Operator”). Please read them before purchasing and using the App.
1. Eligible Users and Permitted Uses
The App may be used by the purchaser personally. Use by the purchaser in personal streams, monetized streams, and videos is permitted. Display in OBS and use as a desktop aquarium are also within this permitted scope.
Displaying the App in streams or videos is different from distributing the App or its bundled asset data. The following conditions apply to handling that data.
2. No Redistribution or Sharing of Purchased Data
Redistributing, transferring to others, or reselling the App’s product data (the EXE, ZIP, and bundled files) is prohibited. Sharing purchased data in a state that allows third parties to use it is also prohibited.
Storage and backups for the purchaser’s own use are not included in this prohibition, provided they do not make the data available for third parties to use.
Third-party software components are subject to the license provisions in Section 6. This section does not restrict rights granted by those licenses or applicable law.
3. Conditions for Standard Fish and Food Images
The standard fish and food images bundled with the App may be used within the App. They may also be displayed in streams and videos made using the App.
However, the following are prohibited:
Redistributing the standard images themselves as standalone assets.
Claiming that you created the standard images.
Extracting standard images from the App and distributing them as separate assets.
The permission to use the App does not transfer copyright in the standard images to the purchaser or authorize their redistribution as standalone assets.
4. Images Added by Users
Users must themselves verify the rights and permissions needed to use added fish or food images and display them in streams or videos. The conditions set by the images’ rights holders must be followed.
The Operator does not individually verify rights in images added by users. If the use of such an image causes an issue involving third-party copyrights or other rights, the user is generally expected to check and address the issue with the rights holder. Where the issue is not attributable to the Operator, the Operator is not responsible for that use. This is not intended to exclude the Operator’s liability under applicable law.
5. Modification and Analysis
Do not modify or analyze the App for the purpose of redistribution or sharing for third-party use prohibited by these Terms, or infringing others’ rights. However, this does not prevent modification, analysis, or other activities permitted by law or third-party software licenses.
Operation and support are not guaranteed after modifications, even when made for the purchaser’s own lawful use. This is not intended to restrict ordinary settings changes or the addition of your own images.
6. Rights and Third-Party Licenses
Rights in the App and its standard assets belong to the Operator or their lawful rights holders. The App includes third-party software. Each such component is subject to the license identified in the bundled third-party license documentation or related notices.
If these Terms differ from a third-party component’s license, that license prevails for that component. These Terms do not revoke rights to use, modify, redistribute, or otherwise handle the component as permitted by its license.
7. Operating Environment and External Services
Please check the distribution page or README for the operating environment. Some or all functions may become unavailable because of your PC environment, Windows or OBS updates, or changes to or discontinuation of external services such as Twitch. Operation in every environment and continued compatibility with external services are not guaranteed.
When using third-party services or software such as Twitch, OBS, or BOOTH, also follow their applicable terms, licenses, and conditions. Purchasing the App does not change your rights to use third-party services or their conditions of use.
8. Updates and Support
Updates and support are not guaranteed to be provided permanently. Please check the current distribution page or other guidance for the content and scope of support.
This provision does not revoke express commitments in the product description or purchasers’ rights under applicable law.
9. Losses, Refunds, and Related Matters
The Operator is not responsible for stream interruptions, data loss, third-party service outages, or similar issues associated with using the App where they are not attributable to the Operator. Users should back up settings, images, recordings, and other necessary data themselves.
These Terms do not exclude or limit liability for losses caused by the Operator’s intentional misconduct or gross negligence, or liability that cannot be excluded or limited under the Consumer Contract Act or other applicable law.
Returns, refunds, cancellations, and related matters will be handled in accordance with applicable law, the terms of the sales service such as BOOTH, and conditions stated on the product page at the time of purchase. These Terms do not impose a “no refunds under any circumstances” rule. Please contact the Operator if you experience a problem.
10. Changes to These Terms
The Operator may change these Terms in accordance with law to the extent reasonably necessary. Changes and their effective date will be announced on this page, the distribution page, or similar channels. Changes requiring individual consent will apply after the necessary consent is obtained. Merely posting a change is not intended to unconditionally impose adverse changes on existing purchasers’ conditions of use.
11. Governing Law
These Terms are interpreted under Japanese law. However, they do not interfere with users’ rights under applicable mandatory laws.
